Big Cherry Sports Picks — Terms of Service

Welcome to Big Cherry Sports Picks (“Big Cherry Sports,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, apps, content, products, and services that provide sports picks, analysis, and related materials (collectively, the “Services”). By creating an account, purchasing a plan, or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Who We Are & What We Do

Big Cherry Sports provides sports handicapping content and analytics for informational and entertainment purposes only.
We do not accept or place wagers, operate as a sportsbook, or provide financial/investment services.
Past results do not guarantee future outcomes. All decisions to place wagers are solely your responsibility.

2) Eligibility & Your Responsibilities

You must be at least 21 years old (or the minimum legal age for wagering in your jurisdiction, whichever is higher) and legally permitted to access sports-betting-related content.
You are responsible for complying with all applicable laws in your location. Do not use the Services where prohibited.
You agree to maintain accurate registration information and to keep your login credentials confidential. You are responsible for all activity under your account.

3) Nature of the Content (No Advice)

Content is informational/entertainment only and not financial, legal, or investment advice.
You understand that sports outcomes are uncertain and that you may lose money if you choose to wager.

4) Plans, Billing & Auto-Renewal

We may offer one-time purchases, memberships, and subscription plans. Unless otherwise stated:
- Subscriptions auto-renew at the then-current price until cancelled.
- You can cancel anytime in your account settings; cancellation applies to the next billing cycle.
- Taxes and payment processing fees may apply.
Prices, features, and availability of plans may change with or without notice, subject to Section 16 (Changes to These Terms).

5) All Sales Final — No Refunds

All purchases are final. Because access to digital picks, data, and proprietary content is delivered immediately upon purchase or scheduled release, we do not offer refunds or credits under any circumstances, including but not limited to:

Dissatisfaction with picks or performance,
Failure to use or access the Services,
Schedule changes, injuries, or unexpected events affecting games,
Accidental purchases or forgetting to cancel before renewal,
Account suspension or termination due to your breach of these Terms.

Limited Exceptions: We may, at our sole discretion, correct duplicate charges caused by our system or comply with refunds required by law. Otherwise, no refunds.

6) No Chargebacks (Material Breach)

You expressly agree not to initiate chargebacks with your bank or payment provider for transactions with Big Cherry Sports.

Filing a chargeback is a material breach of these Terms. If you file or threaten a chargeback:
- We may immediately suspend or terminate your account and access;
- We may revoke all licenses and benefits tied to the disputed purchase;
- We may submit evidence of your access and usage to the payment provider;
- You agree to reimburse us for all costs, fees, and expenses (including reasonable attorneys’ fees and third-party collection costs) incurred in responding to or reversing an improper chargeback.
If you have a billing concern, contact us first at [email protected]. We will review good-faith disputes; chargebacks are not an acceptable dispute method for delivered digital goods.

7) Delivery & Access

Picks and content may be posted on schedules that can change due to news, injuries, market movement, or other factors. No specific posting time is guaranteed.
Temporary interruptions (maintenance, outages, third-party issues) may occur. We do not guarantee continuous or error-free access.
